Lockout Back ON. BOOOO
So the Owners have received a temporary Stay, on the ruling from earlier this week.
In short, I guess this means the doors are locked again this afternoon. On Monday, hopefully we will have a more deffinite decision on whether the appeal will be granted or not. And hopefully this does not delay the Lions plans to start OTA's next Wednesday.
All I know, is I am sick of this shit. I hope all the fans at Radio City Music hall get wind of this before the 2nd round starts up today. And they make the Heat Goodell took last night look like a Standing Ovation.

The sky isn't falling.
This is just a temporary stay while they appeal the actual stay itself, it’s not a complete stay to have the lockout go full on until the real appeal.
Figured.
A temporary stay makes sense until Eighth District gets a chance to hear the argument on why a permanent stay is necessary.
I just hope we get a Ruling on Monday or Tuesday.

I don’t know if you were paying attention, but the owners opted out of the previous CBA which started this whole thing.
The players are doing their best to protect their financial interests (as are the owners). This whole thing was DEFINITELY motivated by the owners opting out of the previous CBA. The legal battle that ensued was a direct result of the owners’ actions not vice versa.
I’m not saying the owners shouldn’t have done what they did (I’m not privy to the specific financials) but saying the “players locked themselves out” is ignoring how this thing became an issue in the first place.

Was the “opt out” provision in the CBA available to both sides and agreed to by both sides?
If so, that’s not a good way to protect your financial interests… by allowing the other party to opt-out.
And to not have a contingent plan to the other party opting out, is also a pretty weak strategy for protecting your financial interests.
…. unless of course, your plan was in fact to litigate if the other party opted out…. BUT if that is the case…. it wouldn’t of been the owners fault…
So in the end.. you just said, in so many words, that the NFLPA are a bunch of morons unable to properly plan a competent strategy for securing their financial future… there fore the Owners are to blame.

I don’t think there was any question that the players were going to take this thing to court. Look who they got to be in charge of this thing- a freakin’ lawyer. And you think the owners weren’t planning on litigation happening when they opted out of the CBA?? Of course they were. They knew that was gonna happen. It was part of the plan, as proven by the TV deal they made.
If the players win this (and it is looking more and more like that will happen), it seems to me to be a VERY competent strategy for securing their financial future.

If anyone is a moron here, it is the owners for not planning around this. As everything that happened following their decision to opt out of the CBA, was apparently predicted by them. If they lose the case, they should’ve opted out later on, when they had a stronger legal plan. This whole thing is happening because they chose to opt out now.

I just had to spend $800 to fix my car and that puts me back like 4 months! To think how much $800 means to me right now, and what these jaggoffs are fighting over. Man, this makes me angry! …after getting into bed with sleazy hillbilly Jerry Richardson and Daniel Snyder (the force behind the lockout, they essentially told the respectable owners like Rooney who didn’t want the lockout to sit down and shut up). The owner’s have perpetually negotiated in bad faith especially with the ever-growing mysterious “expenses” that they were using to manipulate the final cap number and refusing to open their books at all to verify (and the owners should have open books as my tax dollars are paying for their damn stadiums anyways).
The owners wanted this in an effort to break the players union and go back to the pre-unrestricted free angecy days when the players salaries were around $500,000 so they could get all the money. So very “sorry” to see it blow up in their greedy faces.

The expenses aren't that mysterious
If you care to read the old CBA they are clearly spelled out. They are used for things like upgrades and repairs to stadium facilities, NFL Charities, and the NFL Network.
Let me ask you about two points here:
First, the money spent on NFL network results in profits that are also split with the players. So are you saying that it is wrong for the owners to expect the players to also share in the cost of running NFL Network when the players get to have about half the profits from it?
Furthermore, when the past CBA was ratified in 2005, the $1 billion exemption for overhead was about 16.7% of the overall NFL revenues. The players were originally fine with a 16.7% revenue exemption at that time and they agreed to it during the union ratification of the CBA. If the exemption were to be restored to the 16.7% level that the players agreed to in the ratification of the previous CB that would result in a $1.5 billion exemption now that the NFL makes about $9 billion per season. During the previous mediated negotiations in Washington the owners offered to accept a $1.35 billion exemption instead. That figure is still below the 16.7% exemption that the players had agreed to in the 2005 CBA ratification.
My second question is, since the players are making such a big deal about the owners asking them to take a smaller percentage of total revenue, and that is the basis of their complaint, why do they feel it is fair for them to expect the owners to take a smaller percentage of revenue for the overhead exemption than they agreed to in the 2005 CBA ratification? Isn’t that clearly two-faced on the part of the players?

You have to remember
that all of this is int he courts instead of being settled in negotiations because the players chose to litigate. If the players didn’t choose that option and sat down in good faith at the negotiating table we would probably have an agreement by now. The players are actually just as much at blame for this situation. They walked out of mediated negotiations in Washington D.C. Then they disbanded their union and filed the law suit all before the owners locked them out.
So who chose this path?

Not on our timing though. Listening to the Falcons GM it sounds like due to the labor situation and made that big trade because of not thinking they would have free agency. I agree with Mayhew more, who is acting as if it will work out eventually and we are not changing our plans.

Nevertheless, we have to prepare ourselves for the idea that the lockout will be back after the draft is done, if not before. We all hate the idea of this, but from a legal perspective it is pretty common for the defendant to get a stay of the lower court judgment pending appeal. Our courts are reluctant to allow a lower court ruling to cause actions that are irreversible pending the outcome of an appeal. They would try to restore the “status quo” instead.
